About these terms
These terms govern your use of this website and the photography ordering websites hosted on subdomains of orderphotos.online and orderphotos.store (together, the "Sites"). The Sites are operated by Terra Australis Group Pty Ltd (ABN 19 104 212 302), trading as Timestone Software ("we", "us"). By using the Sites you agree to these terms; if you do not accept them, please do not use the Sites.
Ordering sites and photography providers
Each ordering site is operated solely by the photography company named on that site (the "photography provider"). The photography provider populates its site with all photographs and information, sets the products and pricing offered there, takes payment under its own payment arrangements, and produces and delivers the orders placed on its site. Your order is a transaction between you and the photography provider.
We provide the software and hosting platform only. We do not own the photographs or information on the ordering sites, and we do not receive or view order details, payment information or student information handled through them.
The photography provider's own terms prevail
Each photography provider may publish its own terms of trade, ordering conditions and privacy policy on its ordering site or through your school, club or organisation. Those terms govern your order and your relationship with the photography provider. These platform terms provide a baseline only: to the extent of any inconsistency between these terms and the photography provider's terms in respect of your order, the photographs, or your personal information, the photography provider's terms prevail. These terms continue to govern your use of the hosting platform itself.
Your contract of sale is formed directly between you and the photography provider. We are not a party to that contract. Photography providers operate in their own locations, and your contract with a provider is governed by the provider's terms and by the laws that apply to that provider in its jurisdiction — which may be different from the law that governs these platform terms.
Enquiries about orders, photographs and students
Because we do not hold or have visibility of this information, we cannot look up orders or answer enquiries about orders, payments, deliveries, refunds, photographs or student information. All such enquiries must be directed to the photography provider using the contact details shown on its ordering site, or to your school, club or organisation. The contact details at the end of these terms are for platform, business and legal matters only.
Access codes
Galleries on the ordering sites are protected by access codes issued by the school, club or photography provider. You must only use an access code you have been given by the relevant organisation, and you must not share a code with, or attempt to view photographs of, people you are not authorised to view. We may suspend access where a code is misused.
Acceptable use
You must not use the Sites in a way that is unlawful, that interferes with their operation or security, or that attempts to gain unauthorised access to any system, account or gallery. You must not scrape, harvest or bulk-download content from the Sites.
Intellectual property
Photographs displayed on an ordering site are owned by, or licensed to, the relevant photography provider. The software, design and other material making up the Sites is owned or licensed by us. Except as permitted under the Copyright Act 1968 (Cth) or with written permission, you must not reproduce, distribute or create derivative works from any content on the Sites beyond what is necessary to view products and place orders.
Australian Consumer Law
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law that cannot lawfully be excluded, restricted or modified. Consumer guarantees relating to the products you order apply against the photography provider as the supplier of those products. If you deal with a photography provider outside Australia, the consumer laws of the provider's jurisdiction may apply to your contract with that provider.
Disclaimers and liability
While we work to keep the Sites available and secure, we do not warrant that they will be uninterrupted or error-free. The content of each ordering site — including photographs, products, pricing and delivery information — is supplied by the photography provider, may change without notice, and remains the provider's responsibility. Subject to the Australian Consumer Law and to the maximum extent permitted by law, we exclude liability for loss or damage arising from your use of, or inability to use, the Sites, and any implied conditions or warranties are excluded.
The Sites may link to websites we do not operate. Those links are provided for convenience and do not imply endorsement, and we are not responsible for the content or privacy practices of linked websites.
Privacy
Our privacy policy explains how we handle personal information collected through the Sites and forms part of these terms.
Changes and termination
We may update these terms from time to time by publishing the revised terms on this page; changes take effect when published, and your continued use of the Sites constitutes acceptance. We may suspend or terminate access to the Sites where these terms are breached.
Governing law
These terms, and your use of the hosting platform, are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of Victoria and any courts hearing appeals from them. This clause applies to the platform only — your contract with a photography provider is governed as described above, by the provider's terms and the laws applying to that provider.
